1. Types Of Personal Information We Collect

Personal Information is information that can be used to identify, locate, or contact an individual. It also includes other information that may be associated with Personal Information. When you become a Member, a Supporter, begin a Campaign and/or otherwise visit and/or use the Site, we may or will collect from you the following types of Personal Information:

Contact Information, such as, but not limited to, (now referred to as “such as”): your name; email address; postal address; phone number; your Facebook or Twitter information if you are signing up via Facebook Connect or Twitter Login (this will authenticate your identity and link your Facebook or Twitter Profile information, such as your name and email address, to your Tubestart account. Services like Facebook Connect and Twitter give you the option to post information about your activities on our Site to your Facebook profile page or Twitter feed to share with others within your network); all of which allows us to provide you with communications from or on behalf of Tubestart.

Relationship Information that helps us to understand who you are and what types of Campaigns and Products you may be interested in, as a Member and/or Supporter. This includes such things as lifestyle information; location information related to your state/province, city, or neighborhood; areas of interest, information collected from social media interactions (such as via Facebook Connect, our Twitter and Facebook pages) demographic information; information about the types of videos and other media you’re interested in; and, information about friends who refer you or who you’ve referred to us.

Transaction Information about how you interact with Tubestart, such as: the campaigns you view and purchase; other information about how you use ourSite, email, other communications and applications; and, how you interact with our business partners and service providers.

Financial Account Information as needed to process payments to Campaigns from you as a Supporter. We do not store payment information such as your credit card number, expiration date or security ID. We only store a secure token that allows us to process payments on your behalf through the selected payment processor such as WePay, PayPal or Bitcoin email addresses (if we accept these types of payments).


2. How Tubestart Collects Personal Information

We ask you for Personal Information (such as Contact Information and Payment information) when you register to become a Member or Supporter, desire to start a Campaign, create an account, contact us, purchase Products or otherwise use or interact with our Site.

For example, we may track the Products you view or purchase, the Creators you support, the Videos you view, information you provide to be published or displayed on public, Creators-only and other areas of our Site, transmitted to other users of the Site or third parties and the comments you make to Communities (Communities is defined and discussed in section 11 below). We use cookies and related our Site and our business partner websites. You can read more about cookies and other technologies in the Cookies and Related Technologies section, which is section 5 below.

We also collect Personal Information if you contact us via telephone, email, text, tweet, postal mail, social media interaction or other methods of communication, such as for customer support purposes, use the “Search” feature of our Site and your responses to surveys we may ask you to complete.

If the event you purchase our Products as gifts for others, we collect information that you provide us about those other people, such as those persons' Contact Information and Relationship Information.  We also create transaction records of your gift to those persons.

The information about other people is only used for the sole purpose of completing the transaction or for whatever reason it may have been provided.
We will automatically send your friend a one-time email inviting him or her to visit the site.  Tubestart stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

If you use a social media feature, Communities, posts or other method of communication to interact with Tubestart or our Site, that application may have a specific privacy statement that governs the use of Personal Information related to that application. You should find and read that application, as our Privacy Policy does NOT apply to that application.

We may receive additional Personal Information from third parties, which we may use such as to enhance other information we have about you to help us better understand you and to otherwise enhance our Site or our Products.


3. How Tubestart Uses Personal Information

Tubestart uses Personal Information to:

  • Operate and improve our Site;
  • Open an online account for you;
  • Allow you access to Creators and their Videos;
  • Provide you with offers for Products and for products and services from participating partners of ours such as offers based on things such as your stated and anticipated interests, personal characteristics or location;
  • Facilitate and process orders for our Products and for you to be a Supporter of Creators;
  • Evaluate the types of offers, products or services that may be of interest to our Site users and their eligibility for them;
  • Track our Site users purchasing habits of our Products and perform other analytics;
  • Manage and develop our business and operations;
  • Provide customer support, including to our merchants or business partners;
  • Communicate and provide additional information that may be of interest to you about Tubestart and our merchants and business partners, such as Tubestart news, special offers and coupons,  announcements and marketing materials;
  • Send you reminders, technical notices, updates, security alerts and support, administrative messages, service bulletins and marketing information;
  • Provide advertisements to you through our Site, email messages, text messages, tweets, applications and other methods of communication;
  • Administer, sweepstakes, contests and other promotional activities or events sponsored by us or our partners;
  • Manage our everyday business needs, such as Site administration, forum management, fulfillment, analytics, fraud prevention, enforcement of our corporate reporting obligations and our Terms of Use, which you can access by clicking here;
  • For the purposes for which you provide it.

We do not sell your Personal Information to third parties.


4. When And Why We Disclose Personal Information

We will not disclose your Personal Information to third parties except to:


  • Affiliated companies (such as our subsidiaries and other companies owned by or controlled by Tubestart) who may only use the Personal Information for the purposes described in Section above;
  • Our service providers that provide services for us such as sending emails on our behalf, maintaining our data on their servers and databases and processing payments.  Our service providers are bound by law or contract to protect the Personal Information and are only allowed to use the Personal Information in accordance with the terms of our service agreements with them;
  • Third party merchants, but only to the extent you’ve participated in an offer, contest or other activity sponsored or offered through Tubestart on behalf of that merchant. We may also provide merchants with Personal Information to combat fraud and as part of legal proceedings affecting Tubestart and that merchant;
  • Third party services providers whom we may rely on to run or help us to run contests and surveys.  In some instances, navigation to their websites may be seamless, so it may appear that you’re still on our Site. So, please take note of who’s running the event in question and what terms, conditions and policies apply;  
  • Tubestart business partners or advertisers, as part of an offer, contest, or other activity that is provided by or in conjunction with Tubestart and its business partners and in which you’ve elected to participate. For example, if you’re referred to Tubestart from a business partner's website or through an invitation facilitated by or in conjunction with a Tubestart business partner, we may provide that business partner with Contact Information and Transactional Information to validate the referral and to support the terms of the relationship between us and that business partner.  This in turn may allow that business partner to contact you directly and/or to advertise to you;
  • Effect a merger, acquisition or otherwise to support the sale or transfer of business assets; to enforce our rights or protect our property; to protect the rights, property or safety of others; investigate allegations of fraud; respond to a government request; or, as needed for Site support, auditing, compliance and corporate governance functions.  If Tubestart is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified by email and/or prominent notice on our Site of any changes in ownership or uses of your Personal Information, as well as of any choices you may have regarding your Personal Information;
  • To defend ourselves in litigation or a regulatory action and when required or advised to do so by law or our legal counsel in their representation of us, such as response to a subpoena or similar legal process, including to law enforcement agencies,regulators, and courts in the United States and other countries, allegations of intellectual property infringement, piracy, or other unlawful activity or as we reasonably believe necessary to protect and/or enforce our rights;
  • With your approval.

We encourage our third party merchants and business partners to adopt and post their own privacy policies, since they are NOT covered by or governed by ours. So, the use of your Personal Information by such third parties is governed by their privacy policies and is NOT subject to our control. We encourage you to CAREFULLY REVIEW the privacy policies or statements of these third party merchants and business partners.

We may also discloseinformation about you that is not personally identifiable. For example, we mayprovide our merchants, business partners, or other third parties with reportsthat contain aggregated and statistical data about our users.


5. Cookies And Related Technologies

When you use our Site, we also collect certain information by automated or electronic means, using technologies such as cookies, pixel tags, clear gifs (also known as webbeacons and web bugs), browser analysis tools and web server logs.  As you use our Site and apps, your browser and other devices, such as certain types of tablets, communicate with servers operated by us, our business partners and services providers, to coordinate and record the interactivity and fill your requests for Products, services and information.


The information from cookies and related technology is stored in web server logs and also in web cookies kept on the computers from which you access our Site.  This information is then transmitted back to our Site by these computers.  These servers are operated and the cookies managed by us, our business partners or our services providers.

For example, when you visit the Sites, Tubestart and our services providers may place cookies on that computer or device.  Cookies allow us to recognize you when you return to our Site and to track and target your interests in order to provide a customized experience. They also help us to detect certain kinds of fraud.  A "cookie" is a small amount of information that a web server sends to your browser.  It stores information about your account, your preferences and your use of our Site. Some cookies contain serial numbers that allow us to connect your Site activity with other information we store about you in your profile or as related to your interactions with our Site.

Some cookies are temporary, whereas others may be configured to last longer.  We use the following types of cookies:

  • Strictly necessary or essential cookies, whichare critical to the functionality of and to navigate around our Site and use its features.  For example, we use these cookies to keep you logged in to our Site and to remember relevant information about you when you return to our Site;
  • Session cookies, which are temporary cookies used for various reasons, such as to manage page views.  Your browser usually erases session cookies once you exit your browser;
  • Persistent cookies, which are more permanent cookies that are stored on the computers or other devices you use even beyond when you exit your browser.  We use persistent cookies for a number of purposes such as retrieving certain information you’ve previously provided (like your user i.d. if you asked to be remembered) and storing your preferences, such as the types of Products and Campaigns you’ve told us you’re interested in;
  • Performance cookies, which collect anonymous information about how you use our Site.  For example, these cookies help us improve the usability of our Site by allowing us to track how users move around our Site when they are using it;
  • Functional cookies, which also collect anonymous information. They can also provide security in transactions.  For example, we use functional cookies to remember the choices you make and provide enhanced features to improve your user experience, such as by these cookies remembering your user name and configurations of our Site that you customize. 

Pixel tags are tiny graphic images placed on website pages or in our emails that allow us to determine whether you’ve performed certain specific actions.  When you access these pages or open our email messages, the pixel tags generate a notice of that action to us and/or our services providers. These tools allow us to measure response to our communications and improve our web pages and promotions.

We collect many different types of information from the devices you use to access our Site, using these cookies and other technologies.  Some examples of this information are your operating system type, browser type, domain and other system settings, the language your system uses and the country and time zone of your device.  Browsers routinely send these types of information to web servers. Our server logs also record the Internet Protocol ("IP") addresses of the devices you use to interact with our Site.  An IP address is a unique identifier that devices use to   identify and communicate with each other on the Internet.  We may also collect information about the website you were visiting before you came to our Site and the website you visit after you leave our Site, if this information is supplied to us by your browser.

In many cases, the information we collect using cookies and other technologies is used in non-identifiable ways, without any reference to Personal Information.  For example, we use information we collect about users of our Site to optimize our Site and understand its traffic and usage patterns.  Another example is we associate the information we collect using cookies and related technologies with Personal Information. In that case, this Privacy Policy governs how we use that information.

Tubestart has relationships with third party advertising companies to place advertisements on our behalf onto other websites we don’t own or control and to perform tracking and reporting functions for our Site and our advertisements.  We don’t share Personal Information with third party advertising companies.  However, these third parties may automatically collect information about your visit to our Site and other websites, your IP address, your ISP and the browser you use to visit our Site.  They do this by using cookies, clear gifs and other technologies.  A “clear gif”, is a nearly invisible, pixel-size graphic image on a website page, website-based document or email.  It helps us do things like view the URL of the page on which the clear gif appears and the time our Site and the email in questions is viewed.  In emails, clear gifs help us confirm the receipt of and respond to our emails such as those that you forward to friends and family, as well as help us deliver a more personalized online experience.  Information collected may be used, among other things, to deliver advertising targeted to your interests and to better understand the usage and visitation of our Site and the other websites tracked by these third parties.  This Privacy Policy does NOT cover the collection methods or use of the information collected by these third parties and Tubestart is NOT responsible for cookies, clear gifs or other technologies in third party ads. One of Tubestart's third party service providers is Google Analytics.  Google  provides certain analytics and optimization services for our Site.  If you’d like more information on how to remove yourself from the tracking and reporting functions performed for ourSite by Google, please visit the Google Analytics Opt-Out Page at and follow the relevant instructions.

You can also rid your computers of cookies by blocking or deleting them.  This is often done by adjusting your browser’s privacy and security settings.  How to do this depends on the type of browser you use.  Browsers are different, so refer to instructions related to your browser to learn about cookie-related and other privacy and security settings that may be available.  You might also find information about this by clicking your browser’s “Help” tab, or by contacting them.  You can also try typing something like“deleting cookies” and your browser type into an internet search engine. 


6. Your Choices

We think that you benefit from a more personalized experience when we know more about you and the kinds of products and services you like. However, you can limit the information you provide to Tubestart and you can limit the communications that AT sends to you.  In fact, you can decline to provide Tubestart with some or all of your Personal Information. However, doing so may prevent you from becoming a Member or Supporter and participating in a Campaign.


You can manage your email preferences by logging into your account through our Site, entering the "Account Settings" section, and clicking" Notifications" Tab. You can also manage your subscriptions by following subscription management instructions contained in some of the commercial messages that we send you.  You may choose to subscribe or unsubscribe to some or all types of messages.  You can update your subscription preferences whenever you want.  Please note that even if you unsubscribe from promotional messages, we may still need to contact you with important transactional information related to your account and your purchases.  For example, even if you have unsubscribed from our promotional email messages, we will still send you confirmations when you purchase Products from us. 

You can manage how your browser handles cookies and related technologies by referring to theeighth (8th) and tenth (10th) paragraphs of section 6 above.    

You can also manage the sharing of certain Personal Information with us when you connect with us through a social media platform or application, such as through Facebook Connect or Twitter.  Please refer to the privacy settings of he social media website or application to determine how you may adjust our permissions and manage the interactivity between Tubestart and that social media account.

If you wish to opt out of receiving offers directly from Tubestart merchants or business partners, you can follow the opt-out instructions in the emails that they send you.


7. Accessing And Correcting Personal Information

Keeping your Personal Information current and accurate helps ensure that we offer you the types of Products and other products and services we think you want form us, our merchants and business partners.  You can do several things to help keep your Personal Information current and accurate. You can access, correct, update and delete your Contact Information, Financial Account Information and the other information you provided to us to use in your Profile or request that we no longer use your information to provide you Products or other products and services.  You can do this by logging into and accessing the "MyAccount" section of our Site, sending us an email at or by postal mail or phone at the address at the end of the next sentence. While we’re ready to assist you in managing your Personal Information or closing your account, we can’t always delete records of past interactions and transactions.  For example, we’re required to retain recordsrelating to previous purchases on our Site for financial reporting andcompliance reasons.

We’ll retain your information for as long as your account is active, to provide you Products and other products and services, to maintain a record of your transactions for financial reporting purposes and otherwise as we feel is necessary to comply with our legal obligations, resolve disputes and enforce our agreements.


8. Security Of Personal Information

Tubestart has implemented an information security program that contains administrative, technical and physical controls designed to reasonably safeguard Personal Information. For example, we and our third-party payment processor each use industry-standard encryption technology to secure Financial Account Information when it is being transmitted over the Internet.  When our employees need to access your Personal Information in the course of providing our services and/or Products to you, we track it internally.  When ourthird-party providers, like our credit card processing provider need to access your Personal Information in the course of providing our Products, they canonly do so with a password we’ve provided them for this purpose.  We use Security Sockets Layer (SSL) encryption technology to encrypt sensitive personal information (such as youremail or password) before it travels over the internet. Credit card numbers are never stored on our database or servers.


The safety and security of your Personal Information also depends on you.  Where you have chosen apassword or username for access to certain parts of our Site, you areresponsible for keeping this password and username confidential.  Please don’t to share your password orusername with anyone.  We urge you toalso be careful about giving out information in public areas of our Site,through social media features or elsewhere.  The information you share in these areas maybe viewed by any user of our Site or of those other areas. 

However, despite our security program and procedures, you understand and acknowledge that we CAN’T GUARANTEE that any person or entity will be prevented from obtaining Personal Information or any other information, such as through unauthorized means.  We will promptly notify those persons whose Personal Information we learn has been compromised.  Notwithstanding this, TUBESTART DOES NOT ACCEPT LIABILITY for any unintentional disclosure or a disclosure that occurs due to a security breach of our systems or facilities or those of third parties. 9. Notice To Residents Outside The U.S.

Tubestart is head quartered in the U.S. Personal Information may be accessed by us or transferred to us in the U.S. or to our affiliates, business partners, merchants or service providers elsewhere in the world.  This also means that your Personal Information may be stored by us outside the province, state and/or country where you reside.  By providing us with Personal Information, you consent to this transfer and storage. We’ll protect the privacy and security of Personal Information according to our Privacy Policy, regardless of where it is processed or stored.



10. Privacy Practices Of Third Parties

This Privacy Policy ONLY addresses the use and disclosure of information by us through your interaction with our Site. Other websites that may be accessible through links from our Site may have their own privacy statements and personal information collection, use, protection and/or disclosure practices.  We are NOT RESPONSIBLE and do not control the web or other practices of any third parties.  Our affiliates, business partners, merchants or services providers may have their own privacy policies too. We encourage you to CAREFULLY REVIEW the privacy policies or statements of these third party affiliates, business partners, merchants and services providers, prior to providing them with any information or taking advantage of any of their offers or promotions.  Tubestart is NOT RESPONSIBLE for the privacy or security of any information you provide to these third parties.



11. Communities, Blogs, Forums And Widgets

Our Site also offers a publicly accessible blog which is managed by a third party application that may require you to register to post a comment. Please be aware that any information you provide on it may also be displayed publicly and read, collected and/or used by others who access it.  We do not have access or control of the information posted to the blog. You will need to contact or login into the third party application if you want the personal information that was posted to the comments section removed. We display personal testimonials of satisfied customers on our site in addition to other endorsements.  With your consent we may post your testimonial along with your name.  If you wish to update or delete your testimonial, you can contact us at


Our Site also includes social media features, such as the Facebook Like button and widgets and the “Share This” button.  These features may collect your IP address, which page you are visiting on our Site and may set a cookie to enable the feature to function properly.  Social media features and widgets are either hosted by a third party or hosted directly on our Site.  Your interactions with these features are governed by the privacy policy of the company providing it.  This Privacy Policy does NOT cover the collection methods or use of the information collected by these third parties.  We encourage you to CAREFULLY REVIEW the privacy policies or statements of these third parties before you use the social media features.


12. Social Connect

Tubestart offers users of popular social media sites such as Facebook, Twitter or Go+ the opportunity to interact with friends and to share on these social sites.  If you’re logged into both Tubestart and the social media account, when you use our Site's Facebook connection functions, your social media account will be linked with your Tubestart account if the email addresses match.  If the email addresses don’t match, we ask you if you want to link them and you must validate that you control the accounts.  If you’re already logged into Tubestart but not logged into the social media account, when you use our Site's social Login functions, you’ll be prompted to enter your social media credentials.  By proceeding through any of these scenarios, you grant Tubestart permission to access your social media profile information and to use it in accordance with this Privacy Policy.


If you’re not currently registered as a Tubestart user and you use our Site's social media connection functions, you’ll first be asked to enter your social media account credentials and then be given the option to register to join Tubestart.  Once you register with Tubestart and connect with your social media account, you’ll be able to automatically post recent Tubestart activity back to your social media account.  Please refer to the privacy settings in your social media account to manage the performance of your account.


You can import contacts from your Gmail Account to invite them to become members of our site.  We collect the username and password for the email account you wish to import your contacts from and will only use it for that purpose.


13. Children's Privacy

Protecting the privacy of young children is especially important.  Tubestart does not knowingly collect or solicit Personal Information from anyone under the age of 13 or knowingly allow such persons to become Creators or Supporters or to create or otherwise participate in Campaigns.  If you are between the ages of 13 and 17, you can

ONLY use our Site with adult supervision.  IF YOU ARE UNDER 13, PLEASE DO NOT SEND ANY PERSONAL INFORMATION TO US. If we learn that we have collected Personal Information from a child under age 13, we will delete that information as quickly as possible.  If you believe that we might have any Personal Information from or about a child under 13, please contact us immediately at the contact information below.


14. Changes To This Privacy Policy

From time to time, we may update this Privacy Policy to clarify our practices or to reflect new or different privacy practices, such as when we add new features to our Site. If we make any material changes, we’ll notify you by email (sent to the email address specified in your account) and by means of a notice on our Site’s home page and a link to the updated Privacy Policy so you can read it priorto the change becoming effective.  It will have a later Effective Date that the previous version.  We also encourage you to periodically review this Privacy Policy page for the latest information about our privacy practices.



15. California Privacy Rights

Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of Personal Information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. In particular, the law provides that companies must inform consumers about the categories of Personal Information that have been shared with third parties, the names and addresses of those third parties, examples of the types of products or services marketed by those third parties and a cost-free means for you to opt-out of our providing your personal information for these direct-marketing purposes.  To request a copy from us of the information disclosure pursuant to Section 1798.83 of the California Civil Code to exercise your rights under this California law and/or the opt-out form, please contact us via email to
